When property owners in Georgia or elsewhere enlist the services of security teams, they may have a duty to ensure that guards are properly trained and prepared to carry out their duties. Should they fail to take similar measures, the safety of their customers may be placed in jeopardy in the process. A woman has filed a lawsuit accusing a security guard and company of negligence after her husband was shot and killed by a guard who was not authorized to carry a firearm.

Reports of the incident

The incident reportedly took place after a married couple arrived to shop at a local hardware store. The lawsuit states that, for reasons that remain unclear, members of the security team were told to harass and detain the man. Reports indicate that these instructions were provided by property owners, but no information was given as to why.

The lawsuit states that after exiting the store and getting into their vehicle, the couple was approached by a security guard who sprayed the man with pepper spray. The guard moved in front of the vehicle, and although the lawsuit states that the couple attempted to comply with demands, the guard then proceeded to fire several shots into the vehicle, hitting and killing the man in the process. According to the lawsuit, the guard was not certified to carry a firearm, and the property owners have also been accused of encouraging unlawful behavior and failing to properly train the guard.

The possible repercussions of negligence

The presence of negligence in property security measures can have dire repercussions. Those subjected to similar issues could suffer severe or permanent harm in the process, or such a scenario could even leave surviving family members grieving over an unexpected loss. Individuals in Georgia who suffer harm or loss under such circumstances could benefit from consulting with an attorney for guidance on all their available options for legal recourse and assistance in preparing to seek the restitution entitled through a claim against all parties deemed responsible.
